1. Scope & Provider

These Terms & Conditions govern the use of the digital knowledge vault "Origin Intelligence" operated by Eva Engel, DNA-Consulting by Eva Engel, Sonnenblumenweg 4, 65396 Walluf, Germany ("Provider"). By completing a purchase, the customer ("User") agrees to these Terms.

2. Product Description

Origin Intelligence is a paid, private online knowledge library ("Vault"). Access is granted via a personal user account after payment. The content is educational and analytical. It is provided as text on a protected website. No physical goods, downloads, or files are delivered. The Vault may be expanded with additional content over time at the Provider's discretion. The Provider does not guarantee a specific scope, frequency, or schedule of updates.

3. Contract Formation

The presentation of Origin Intelligence on the website constitutes a non-binding invitation to purchase. A binding contract is formed when the User completes the checkout process and payment is successfully processed via the payment provider (Stripe).

4. Prices & Payment

All prices are displayed inclusive of applicable statutory value-added tax (VAT) where required. Payment is processed securely via Stripe. The Provider reserves the right to change prices for future purchases. Price changes do not affect existing purchases.

5. Right of Withdrawal & Digital Content Waiver

EU consumers have a statutory 14-day right of withdrawal.

However, in accordance with Art. 16(m) of Directive 2011/83/EU and § 356 Abs. 5 BGB, the right of withdrawal expires once access to the digital content has been granted, provided that:

(a) the User has been informed prior to purchase that the right of withdrawal will be lost upon access being granted;
(b) the User has expressly consented to immediate performance (i.e., immediate access to the Vault);
(c) the User has acknowledged the loss of the right of withdrawal.

By completing the purchase, the User expressly consents to immediate access and acknowledges that the right of withdrawal is thereby waived.

Widerrufsbelehrung: Verbraucher haben ein gesetzliches 14-tägiges Widerrufsrecht. Dieses erlischt gemäß § 356 Abs. 5 BGB, sobald der Zugang zu den digitalen Inhalten gewährt wurde und der Nutzer vor dem Kauf ausdrücklich zugestimmt hat, dass der Zugang sofort bereitgestellt wird, und dabei zur Kenntnis genommen hat, dass das Widerrufsrecht mit Zugangsgewährung erlischt.

6. Access & Account

Access is personal and non-transferable. Each purchase grants access to one (1) personal user account. Sharing login credentials, redistributing content, or granting third-party access is strictly prohibited. The Provider reserves the right to terminate access without refund in case of violation.

7. Intellectual Property

All content within the Vault — including but not limited to text, structure, compilation, and presentation — is the intellectual property of the Provider and protected under German and international copyright law. No content may be reproduced, distributed, modified, publicly displayed, or used for commercial purposes without prior written consent.

8. Disclaimer — No Medical, Therapeutic, or Professional Advice

The content provided in Origin Intelligence is strictly educational and informational. It does not constitute medical advice, psychological counseling, therapeutic treatment, or any form of professional healthcare. The content does not replace consultation with qualified medical professionals. The Provider assumes no liability for actions taken based on the content. Users are solely responsible for how they interpret and apply the information provided.

9. Limitation of Liability

The Provider's liability is limited to intent and gross negligence. In cases of slight negligence, the Provider is only liable for breach of essential contractual obligations (cardinal obligations), and such liability is limited to foreseeable, contract-typical damages. This does not apply to claims arising from injury to life, body, or health, or under the German Product Liability Act (Produkthaftungsgesetz). The Provider is not liable for the accuracy, completeness, or timeliness of the content provided.

10. Availability

The Provider endeavors to maintain availability of the Vault but does not guarantee uninterrupted access. Temporary unavailability due to maintenance, technical issues, or force majeure does not constitute a breach of contract and does not entitle the User to a refund.

11. Data Protection

The processing of personal data is governed by the Provider's Privacy Policy, which complies with the General Data Protection Regulation (GDPR / DSGVO).

12. Governing Law & Jurisdiction

These Terms are governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers within the EU, mandatory consumer protection provisions of their country of residence remain unaffected. The place of jurisdiction for all disputes — to the extent legally permissible — is Wiesbaden, Germany.

13. Severability

If any provision of these Terms is or becomes invalid, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the economic intent of the invalid provision.

14. Amendments

The Provider reserves the right to amend these Terms at any time. Changes will be communicated via the website. Continued use of the Vault after notification constitutes acceptance of the amended Terms.
